Factoring Law and Practice

This book examines the essence of the factoring relationship from both the legal and commercial perspective. An account of the historical development of factoring is followed by an exposition of the nature of factoring facilities. Consideration is also given to the commercial interests of the parties involved be they the supplier (the client), the factor, the debtor or the banker. The operation of these relationships and the use and abuse of factoring arrangements is explored through the discussion of several case studies. Attention is also given to the skills and resources of the factor and his role in commercial practice. A number of forms and precedents can be found in the appendix. They include a factoring agreement and codes of practice which illuminate the problems discussed in the text and provide practitioners with a handy reference source.
